Hugh de Mortimer, son and heir, was under age at his father's death, and was given in ward to William (de Beauchamp), Earl of Warwick. In Dec 1295 he had livery of his inheritance, and made a settlement of his estates. In 1297 and later years he was summoned for military service in Flanders and against the Scots. On 26 Jan 1296/7 he was summoned to the assembly at Salisbury, and to Parliament on 6 Feb 1298/9 (and again on 10 April), by writs directed Hugoni de Mortuo Mari, whereby he is held to have become Lord Mortimer. In June 1300 he took part in the siege of Carlaverock, in the third division.

Hugh de Mortimer married, apparently by 1290, Maud, a niece of William le Marshal, whose surname is not known*. He died s.p.m., 20 Jul 1304, and was buried 15 Aug, in Worcester Cathedral, having apparently been accidentally poisoned by his wife, who received a formal pardon therefor in 1305 at the instance of Queen Margaret. Maud was allowed dower in Oct 1304, and her marriage was granted, to the Queen in Apr 1305. She died on or before 15 Feb 1307/8, when the writ to the escheator issued.

*She was probably a relation of Queen Eleanor of Castile, whose son, in the correspondence calls her 'nostre chere cosine Dame Maud de Mertimer du Chastel Richard'.
