A short article in Genealogists' Magazine 13 (1959): 8-9 discusses the evidence that Elizabeth, daughter of Roger de Mowbray, married Adam de Mewmarch (died c. 1303), of Womersley, co. York. It cites a source which states that Elizabeth had 30 librates of land in Althorpe, co. Lincoln in marriage.

Recently I encountered a law suit which provides additional evidence for this marriage. P.A. Brand in the book, Earliest English Law Reports, vol. 2 (Selden Soc., vol. 112) (1996): 326-327, presents an abstract of this suit dated 1279 which clearly identifies Adam de Newmarch's wife, Elizabeth (called Isabel here), as daughter of Sir Roger de Mowbray.

This is a partial transcript of the lawsuit abstract:

"Ralph fitzGalien brought a writ of aiel against Robert Bouchard. Robert answered that he only claimed the free tenement and could not answer without Isabel daughter of Roger de Mowbray in whom the fee and right lay and her husband Adam de Neumarche.

Adam and Isabel came and put themselves in the tenancy and vouched Roger de Mowbray, the son and heir of Sir Roger de Mowbray. He came and asked why they had vouched him.

Bradfield (for Adam and Isabel). Sir Roger de Mowbray, the father of this Roger de Mowbray, gave this land to Robert Bouchard for life for fourteen shillings a year with reversion to Sir Roger at Robert's death. Then Sir Roger de Mowbray enfeoffed Isabel his daughter of other lands and of the service of Robert Bouchard from this tenement and all the right which could come to him from it, and obliged himself and his heirs to warranty by this charter: 'Know all men, both present and future, that I Roger de Mowbray have given to Isabel etc. so much land etc., that is all the land which G. held and was my escheat from G. to have and hold to Isabel and the heirs of her body, as fully as Roger de Mowbray held it both in demesnes and in services and with all the right which could come to him from the said land etc.'

Thornton (for Roger de Mowbray). Sir, we tell you that the charter is of no use to them because, although they have said Sir Roger de Mowbray gave his daughter the service of Robert Bouchard and the reversion of his tenement with other land, the charter makes no mention either of the service or of the reversion. So we ask for judgement etc.

Bradfield. Sir, this land is the escheat of Sir Roger de Mowbray which G. held of him, which Roger de Mowbray gave to Isabel as fully as he held it, both in service and the reversion of this land in as much comprised in the charter as the other lands belonging to the escheat of which Isabel is currently in seisin and Sir Roger de Mowbray gave the whole of the escheat both in service and in demesne with all the right which could fall to him we ask for judgement."

The abstract of the lawsuit continues but no further genealogical details are provided. No indication is made where the land in question was located.


Adam married Isabel de Mowbray, daughter of Roger de Mowbray and Daughter of Thomas de Furnival.
