Will: In the Name of God Amen. The seventeenth day of October A.D. 1761 I Plege Nye of Sandwich in the County of Barnstable and Province of the Massachusetts Bay in New England husbandman, being under decay of body but of sound mind and memory Do make this my Last Will & Testament and first I commend my Soul to God hoping for mercy Through Jesus Christ my Saviour and my body to the Earth to be buried in a decent manner at the Discretion of my Executor hereafter named as to my worldly Estate I give devise and dispose of it as followeth:
Imprimis. My Will is that my just debts and funeral charges be first paid by my son Joseph. Item. I Give and Bequeath to my wife Elizabeth, in Liew of her Dower or Power of thirds during her continuing my widow Liberty of Living in my dwelling house and the use and improvement of all my household goods and suitable diet clothing all other neccessaries of Life be supplyed her by my son Joseph During said Term.
Item. I Give my Daughter Abigail Nye seventeen Pounds six shillings and eight pence Lawful money to be paid her by my son Joseph within three years after my Decease I also give her one cow Winter and Summer so long as she continues unmarried to be suplyed by my son Joseph also Diring that Term Liberty of Living and keeping her household goods in my now Swelling House and after my wife Decease of Marriage I give her one half of all my household goods.
Item. I Give my Daughter Elizabeth Gifford Thirteen Pounds six shillings and eight pence Lawful money to be Paid her by son Nathaniel within three years after my Decease and one half my household Goods after my wifes Decease or Marriage.
Item. I Give my Grandson Peleg Nye one Pounds six shillings and eight pence to be Paid Equally Between my sons Nathaniel and Joseph when he arrives to twenty one years of age.
Item. I Give my Grandson Peleg Nye, Peter Nye Nathan Nye Nathaniel Nye, Shadrach Nye Elisha Nye & Bartlett Nye all my wearing apparel to be Equally Divided between them.
Item. I Give and Bequeath to my son Nathaniel Nye and to his heirs and assigns forever all my Land which I bought of the heirs of James Gifford and the Westerly part of my Land lying by the springs above his house Divided from the other part by a fence and one half of my Twenty acre Lott and one half my Interest in the upland of the Pine Islands so called and one half my salt meadow lying Between Pine Islands and Dester's Island and one half of my small Pine Wood Lotts and one half of my farming Tools & Instruments Provided and it is the Condition of the above Legacies and Devices to my son Nathaniel that he Pay to my Daughter Elizabeth and my Grandson Peleg as is above ordered.
Item. I Give and Bequeath to my son Joseph Nye and to his heirs and assigns forever my Home Place lying above the way Including land & buildings and the upland marsh Lying below and adjoying to the way near my Barn and the easterly part of my Land lying by the Springs above my son Nathaniel's House divided from the other Part by a fence and one half of my Twenty Acre Lott & one half of my Interest the uplands of Pine Islands and Dexter's Island and all my little wood lott which I took up with Richard Launders and all my wood Lott Lying near to James Atkins dwelling house and one half my small Pine wood lott and all my salt marsh and meadow lying Between Sandy Neck and Pine Island and one half my between Pine Island and Desters Island and all my qyick stock Except on Cow and one half of my Farming Tools and instruments and all my notes of hand Credits and cash Provided and the Condition of the within and above Devises and Legacies to my son Joseph is that he Perofrm as in here in Ordered for my Wife and Daughter Abigail and Grandson Peleg and Pay my Just Debts and funeral charges.
Item. I Give and Bequeath to my two sons Nathaniel and Joseph and to their Heirs and assigns forever to be Equally Divided between them all my Estate Real & Personal not herein before otherwise Disposed of.
Lastly. I Constitute and appoint my son Nathaniel Nye Sole Executor of this my Last Will and Testament hereby revoking and making void all other and former Will or Wills by me at any time heretofore made Ratifying and Confirming this and no other to be my Last Will and Testament, In witness whereof I have hereunto set my Hand and Seal the Day first written. Be it known to all men by these Present that whereas I, Peleg Nye of Sandwich in the County of Barnstable have made and declared my last will and testament in writing bearing date the 17th of October A.D. 1761 I the said Peleg Nye by this Present Codicil do Ratify and confirm my sd Last Will and Testament with the following additions viz. I do give and bequeath to my son Josephy Nye his heirs and asigns forever the Piece of Land Lying before my door adjoying to the River that I bought of the Town Agents and my will and meaning is that this codicl or Schedule be and be Judged to be Part and Parcel of my last will and Testament and that the Lands herein Devised be as be as truly Given and conveied to my son Joseph and his heirs and assigns forever as if the same ware so Declared and set down in my sd Last will & Testament to which this Codicl is annexed. Witness my hand and seal the fourth Day of November A.D. 1761.
